Trump USDA Just Shut Down the Biden Race-Based Loan Program That Punished White Farmers

Joe Biden told two million American farmers they didn't qualify for federal loans because of their race.

Now the Trump administration just settled the lawsuit that buried it for good.

You won't believe how long this program survived after courts ruled it unconstitutional.

Biden's USDA Farmer Loan Program Was Ruled Unconstitutional — Then Kept Running

In 2021, Joe Biden's USDA launched a $4 billion Farmer Loan Forgiveness Program.

The program paid up to 120 percent of outstanding debt – more than you owed – but only to farmers the USDA classified as "socially disadvantaged."

The USDA's own definition: Black, American Indian, Alaskan Native, Hispanic, Asian, or Pacific Islander farmers.

White farmers were not on the list.

That wasn't a footnote buried in regulatory code.

That was official federal policy, signed off at the highest levels of Biden's Agriculture Department.

Adam Faust, a dairy farmer from Chilton, Wisconsin, read it and sued.

He became the first farmer in America to take Biden's USDA to court over racial discrimination in the program – and he won.

A federal judge issued a nationwide restraining order and ruled that handing loan forgiveness only to "socially disadvantaged farmers" was unconstitutional race discrimination.

Biden's response was to quietly rewrite the programs, rename the criteria, and keep discriminating.

The Wisconsin Law Firm That Sued Biden Over DEI Farm Programs 12 Times and Won Every Time

The Wisconsin Institute for Law and Liberty – WILL – didn't fight this once.

They sued Biden's administration 12 times over race-based federal programs.

They won every time – against the Farmer Loan Forgiveness Program, the Restaurant Revitalization Fund, the Minority Business Development Agency, the Disadvantaged Business Enterprise Program, and the McNair Scholarship Program.

Biden's agencies kept rebuilding the same unconstitutional programs under different names, and WILL kept tearing them down.

Last June, WILL filed again – this time targeting three programs that survived the earlier battles: the Loan Guarantee Program, the Dairy Margin Coverage Fee, and the EQIP Grant Program.

All three still used race and sex as eligibility criteria.

Six Republican Wisconsin congressmen wrote directly to Agriculture Secretary Brooke Rollins demanding she end them.

Trump's USDA filed court documents in February 2025 declaring the programs unconstitutional.

Now WILL secured a full settlement – the USDA ends the race and sex criteria across all three programs and pays WILL's attorney fees.

WILL Deputy Counsel Dan Lennington said it plainly: "The Trump Administration inherited dozens of discriminatory programs that supported certain farmers over others based on race and sex. Those shameful days are now behind us."

What Comes Next for Race-Based Federal Programs Beyond the USDA

Biden didn't just bury this discrimination in the USDA.

He spread it across the entire federal government – $124 billion in race-based spending that has no business existing.

Secretary Rollins issued a department-wide rule in July 2025 stripping race and sex preferences from USDA programs – but the three programs targeting Faust survived even that.

It took another lawsuit, another filing, another round of litigation to finish the job.

WILL has pending cases against race-based federal scholarships and affirmative action programs across the government.

The USDA settlement is proof the strategy works – and one Wisconsin law firm is the only organization in America systematically hunting these programs down, agency by agency, and winning every single time.

Biden buried his discrimination so deep inside federal bureaucracy he thought complexity would protect it.

He was wrong.
