Sunny Hostin has spent years telling America that privilege is a national emergency.
Then her son called her when he was in a jam.
What she told him before realizing she was on speakerphone is something she can never take back.
Gabriel Hostin Bodycam Catches The View Host on Speakerphone
Metropolitan Transportation Authority officers found Gabriel Hostin, 24, on active Metro-North railroad tracks near 24 Station Plaza in New Rochelle on June 16. He told them he was out for a jog, spotted what looked like a gravel incline, and slipped through a gate he claims was standing open.
Officers released photos of the no-trespassing signs he says he never saw.
Gabriel was already on the phone with his mother when officers walked up. According to NewsBusters' analysis of the footage, Hostin – seemingly unaware her son had her on speakerphone – instructed him to deceive police: "Tell them your mother is a federal prosecutor."
Sunny Hostin is not a federal prosecutor. She is a co-host of ABC's The View, and she hasn't prosecuted a case in decades. She told her son to misrepresent who she was before she understood police could hear her.
Once she realized officers were listening, her story changed fast. "My name is Sunny Hostin and I'm one of the co-hosts of 'The View' and I'm a former federal prosecutor," she announced to Officer Gomez.
The officers kept writing.
The Harvard Trespassing Defense and the Felicity Huffman Problem
Hostin showed up in person and picked up right where she left off. She told officers Gabriel was a Harvard graduate, a Yale researcher, and a man who teaches fourth-grade geometry to South Bronx kids.
"Why would you put something on his record like this?" she pressed Gomez, per the body camera footage.
Officers explained the charge had already been reduced. Gabriel had been caught in an area where trespassing is normally a misdemeanor. They cut it to a violation – meaning he would likely pay a fine.
"It's an arrestable offense," one officer said. "Where you were on the tracks is an arrestable offense. I want to make that clear."
Hostin followed up in writing. Representing her son as his personal attorney, she sent a letter to Westchester County Assistant District Attorney Amanda Greene asking for the case to be dropped entirely.
The letter, obtained by TMZ, argued Gabriel made an honest mistake – open gates, no visible sign, an innocent training jog. NewsBusters pinpointed the location and found industrial storage, not a training hill – a back road tucked behind several buildings, stacked with pallets and construction material, with no sight line from any main street.
Gabriel's court date is set for July 31.
No One Is Above the Law Except Sunny Hostin
In May 2024, Hostin told The View audience that Caitlin Clark's popularity was the product of "white privilege," "pretty privilege," and "tall privilege." In 2019, when actress Felicity Huffman was caught paying to rig her daughter's college admissions, Hostin was livid when Huffman asked a judge for leniency.
"She had wealth, privilege and a platform, and she didn't use it appropriately," Hostin said at the time.
She also spent years telling viewers that no one – not even a president – gets to walk. When Trump was indicted in 2023, Hostin was elated on air.
"No one is above the law," she told the audience. "You can't commit so many crimes and think that you are above the law, even if you are the president." She repeated it through every subsequent indictment.
Then police bodycam caught Hostin doing exactly that – invoking her television platform, her legal pedigree, and her son's Harvard diploma to pressure transit police into letting a 24-year-old adult walk from a citation on active railroad tracks.
Every tool she reached for is one she has spent years telling America was evidence the whole country was rigged. The only difference is that Hostin's variety came with a speakerphone.
In 2025, Hostin made headlines claiming the residents of her "all-white neighborhood" were racists who would call police on Gabriel for jogging. She marched down to the local precinct and warned officers directly: do not harass him, do not stop him.
The threat to Gabriel wasn't the neighbors.
The cops didn't move either time – but only one of those encounters was caught on camera.
