Daniel Penny served his country in the military only to come home and save countless innocent subway riders in New York from a deranged homeless man.

And because of those heroic actions, his life has been hanging in the balance.

But now Daniel Penny’s legal team has Alvin Bragg in a pretzel after they hit him with a bombshell he may never recover from.

No good deed goes unpunished by Democrats

Former U.S. Marine Daniel Penny is paying the price for having the wrong skin color.

Manhattan Democrat District Attorney Alvin Bragg, New York Democrat Attorney General Letitia James, and New York Democrat Governor Kathy Hochul turn a blind eye to crimes committed by supposed “aggrieved minority communities.” 

Meanwhile, Penny saved lives but now finds himself on trial for doing so and could spend 15 years in prison if convicted. 

Penny is fighting against manslaughter and criminally negligent homicide charges from Bragg.

In the spring of 2023, 30-year-old Jordan Neely – a homeless man with a long criminal rap sheet who happens to be black – hopped on a New York City subway car and, according to many witnesses, began threatening the lives of all the innocent people on board.

While passengers called the police for help, the Marine veteran wrestled Neely to the ground and put him in a retaining hold until police could arrive.

While some might find the video below disturbing, it’s important to note that it indicates Neely was still breathing after Penny released him.

It took the police nearly 15 minutes to respond to the crime.

Neely was later pronounced dead at the hospital.

But instead of rewarding Penny, New York Democrats decided to punish him with virtually no evidence.

“The chokehold did not cause the death”

In fact, Penny’s legal team just introduced expert testimony showing Penny’s defense goes beyond the obvious self-defense argument.  

Fox News is reporting an expert forensic pathologist investigated the incident and found Penny is in the clear. 

According to Fox News, Dr. Satish Chundru is parting ways from the state’s medical examiner in regard to Neely’s cause of death. 

“The chokehold did not cause the death,” Dr. Chundru testified.

Dr. Chundru added that in his expert medical opinion, Neely died from the combination of sickle cell crisis, schizophrenia, and synthetic marijuana in his system while the struggle and restraint happened. 

“Someone schizophrenic, high on K2 and involved in a struggle can die without a chokehold being involved at all,” Dr. Chundru found. 

State’s medical examiner changed her mind

Dr. Chundru’s testimony directly contradicts the controversial findings of the state’s medical examiner. 

Dr. Cynthia Harris testified earlier in the trial, suggesting that it was specifically Penny’s restraint of Neely and no other factors that led to the death. 

However, The New York Post reported that during cross examination, Dr. Harris was forced to admit that she changed the initial autopsy report only after watching the viral video of the incident. 

“After watching it, I had no further questions about how he was dead,” Dr. Harris testified. 

In her original report, she found the cause of death was “inconclusive.” 

She went on to add that after watching the clip, “no toxicology result could have changed my opinion,” Dr. Harris continued. “He could have come back with enough fentanyl to kill an elephant.”
