Now the company is ripping out those paper price tags and replacing them with something that works very differently.
What Walmart installed on its shelves this year is why a shopper last week paid six times more for a pair of kids' shoes than the tag said.
Walmart Dynamic Pricing and Digital Shelf Labels Are Already Changing What You Pay at the Register
Walmart ripped out the paper price tags in 2,300 stores and replaced them with small digital screens that update prices wirelessly in real time.
The company said it was an efficiency upgrade — store employees could update every price in the building in minutes instead of walking the aisles for two days swapping paper tags by hand.
When toilet paper disappeared from shelves in March 2020, a few retailers quietly doubled the price overnight while panicked families were loading their carts — and states called it what it was: price gouging.
What Walmart built is a system that does the same thing automatically and without a crisis as an excuse — and the company filed two patents this year to prove it.
In January 2026, Walmart secured a U.S. patent for a system that "dynamically and automatically updates item prices" based on predicted demand and individual price sensitivity.
The second patent goes further — a machine learning system that recommends prices using each customer's purchase history, payment methods, and customer ID, meaning the price isn't set for everyone in the store but targeted to what the algorithm decides a specific shopper will accept.
A mom named Kat documented what that looks like in practice.
She scanned a pair of kids' shoes at the back of a Walmart last week, confirmed the $3 sale price, loaded them into her cart, and walked to the register.
Twenty minutes later, the same shoes rang up at $18.98.
When she scanned the shoe again at the register, the price had changed while she was shopping.
"This scares me because that means that it's choosing the price based on where I'm standing in the store," she told the employee standing next to her, "and that's unacceptable."
James Comer Launches Surveillance Pricing Investigation as Walmart and Instacart Get Caught Price Gouging
Kat's shoes are the clearest proof yet that this is already happening.
An investigation into Instacart found that its AI pricing system produced price differences as high as 23% on identical products — a gap that costs individual families more than $1,200 a year at checkout.
Instacart called this practice "smart rounding" in letters to retail partners and described it as a tool to improve customers' "price perception."
After the investigation went public, Instacart shut the program down.
James Comer launched a formal House Oversight Committee investigation into surveillance pricing on March 5, warning that companies were using consumer data to "weaponize personal data" against the very shoppers they serve.
Comer's committee sent letters to major retailers demanding documentation on their pricing systems and whether customers are being charged different prices for the same goods.
Maryland already passed the Protection from Predatory Pricing Act — the first state law banning companies from using personal data to inflate prices.
Eight more states are moving similar bans this legislative session.
A national survey released this week found 68% of Americans believe surveillance pricing will drive up grocery costs, and 67% support banning both the digital tags and the AI pricing systems behind them.
Inflation ran at 3.8% year over year in April — already outpacing wage growth of 3.6% for the first time since 2023.
The retailers that gouged families on toilet paper in 2020 at least had the decency to wait for a crisis — Walmart built a system that does not need one.
