Liberal judge blocks Trump from sending home over half a million migrants

President Donald Trump was dealt a frustrating blow on Monday when a federal judge blocked his administration from revoking the legal status of more than 530,000 migrants from Cuba, Haiti, Nicaragua, and Venezuela.

These aliens flew into the United States during Joe Biden’s Presidency under his controversial CHNV mass humanitarian parole program.

Judge Indira Talwani, an Obama appointee, ruled that the Trump administration cannot simply cancel these aliens’ legal status with a stroke of a pen.

“The Termination of Parole Processes for Cubans, Haitians, Nicaraguans, and Venezuelans, 90 Fed. Reg. 13611 (Mar. 25, 2025), is hereby STAYED pending further court order insofar as it revokes, without case-by-case review, the previously granted parole and work authorization issued to noncitizens paroled into the UnitedStates pursuant to parole programs for noncitizens from Cuba, Haiti, Nicaragua, and Venezuela (the ‘CHNV parole programs’) prior to the noncitizen’s originally stated parole end date,” Judge Talwani wrote in her ruling.

The judge ruled that each alien needs to have an individualized, case-by-case review before having their status revoked.

Biden’s open borders program haunts Trump’s immigration agenda

The CHNV program was a significant Biden-era immigration policy. It allowed aliens from Cuba, Haiti, Nicaragua, and Venezuela to fly directly into the United States if they had American sponsors, bypassing the dangerous journey to the southern border.

Biden started the program in 2022 with Venezuelans before expanding it to the other countries in 2023. Under the program, these aliens received legal status known as “parole” and work permits for two years.

A Trump administration official expressed outrage over the ruling, telling Fox News: “It is pure lawless tyranny.”

The frustration stems from the fact that Judge Talwani has essentially ruled that Trump cannot use the same executive authority to cancel the program that Biden used to create it in the first place.

Biden’s program plagued with problems

What makes this ruling even more infuriating is that the CHNV program has been riddled with problems since its inception.

Biden’s program hit the brakes after investigators found widespread fraud.

Things got even worse when several aliens who came in under this program got arrested for child rape.

The Trump team gave these 532,000 aliens their marching orders back in March.

They had until April 24 to pack up and leave – just one month from when Trump made the announcement official on March 25.

Judge Talwani’s ruling now throws that plan into chaos, allowing these aliens to remain in the country for the foreseeable future.

The latest obstacle in Trump’s immigration battle

This ruling represents the latest in a series of judicial roadblocks that President Trump has faced in his efforts to get control of America’s immigration crisis.

Trump campaigned heavily on border security and addressing immigration issues during the 2024 election.

The Department of Homeland Security has been working to implement Trump’s immigration agenda, with recent reports indicating plans to resume construction of the southern border wall.

However, liberal judges appointed by Democrats continue to throw up obstacles to these common-sense reforms Americans overwhelmingly voted for.

The White House has not yet issued a formal response to Judge Talwani’s ruling, but sources close to the administration indicate that they are exploring all options, including an appeal to higher courts.

While the legal battle plays out, hundreds of thousands of aliens who entered the country under Biden’s controversial program will continue to remain in the United States, with full legal status and work authorization.
